These terms and conditions of sale are entered into by the seller and any individual or legal entity wishing to make a purchase via this website. This person is hereinafter referred to as "the buyer".
Any natural or legal person who has purchased a product or service from a partner and contracting company is also referred to hereinafter as "the buyer" .
Purpose:
The purpose of these terms and conditions of sale is to define the contractual relationship between PHYTOCORSA A and the purchaser, as well as the terms and conditions applicable to all purchases made through PHYTOCORSA A's merchant site, whether the purchaser is a professional or a consumer.
The acquisition of a product or service through this site implies unreserved acceptance by the purchaser of these conditions of sale.
These conditions of sale shall prevail over any other general or special conditions not expressly approved by PHYTOCORSA A. They will also prevail over the general conditions of a partner and contracting company which is deemed to adhere to them.
PHYTOCORSA A reserves the right to modify its conditions of sale at any time.
In this case, the applicable conditions will be those in force at the date of the order by the purchaser.
Characteristics of the goods and services offered:
The products and services offered are those listed in the catalogue published on the PHYTOCORSA A website.
These products and services are offered subject to availability.
Each product is accompanied by a description prepared by the seller.
Prices :
PHYTOCORSA A reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only price applicable to the purchaser.
The prices indicated include the costs of order processing, transport and delivery insofar as they take place in the geographical zones specified below.
Prices may be subject to promotions linked to a contract with a partner company.
Orders :
Buyers wishing to purchase a product or service directly must :
- fill in the identification form with all the contact details requested or give their customer number if they have one;
- complete the online order form, giving all the references of the products or services chosen;
- confirm their order after checking it;
- make payment in accordance with the terms and conditions;
- confirm their order and payment.
Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement that you are fully aware of them and waiver of your right to invoke your own terms and conditions of purchase or any other terms and conditions.
All the data supplied and the recorded confirmation will be deemed proof of the transaction. Confirmation shall constitute signature and acceptance of the transactions carried out.
The seller will send confirmation of the registered order by e-mail.
Withdrawal concerning the purchase of one or more training courses:
In accordance with Articles L. 121-21 et seq. of the French Consumer Code, the purchaser has a statutory period of fourteen days - prior to accessing the services - to make his or her decision to withdraw known. He/she must send a request for a decision to withdraw, free of ambiguity.
The retraction will take effect if PHYTOCORSA A is unable to satisfy the purchaser by any means that it finds coherent. The reimbursement will then take effect before a legal deadline of fourteen days.
In order to benefit from this right, the purchaser must expressly stipulate - at the time of purchase - that he/she does not wish to start the training course before 14 days have elapsed from the date of receipt of his/her payment.
In accordance with the French Consumer Code - article L121-21-8, 1° and 13° - the purchaser may not exercise his/her right of withdrawal for services such as e-learning courses once they have been started or fully executed.
The purchaser therefore formally acknowledges and accepts that, in all cases where he/she purchases an e-learning course without requesting a postponement, he/she expressly requests the start of the service. The start of the course is indicated by the "time code" on the computer server. From this point onwards, the purchaser expressly waives the right to withdraw from the contract and may not validly invoke this right.
Product deliveries:
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area.
Delivery times are given as an indication only; if they exceed thirty days from the date of the order, the sales contract may be terminated and the purchaser reimbursed.
Liability :
The seller, in the online sales process, is only bound by an obligation of means; it may not be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown in service, or other involuntary problems.
It will never be held responsible for the errors, failures or deceptions of a partner or contracting company.
In case of doubt, the buyer should contact PHYTOCORSA A prior to any purchase, who will be able to inform him/her of the veracity of an offer.
Intellectual property :
All elements of the PHYTOCORSA A site are and remain the exclusive intellectual property of PHYTOCORSA A.
No one is authorised to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, any elements of the site, whether written, software, visual or audio.
Any simple link or hypertext link is strictly forbidden without the express written consent of PHYTOCORSA A.
Personal data:
In accordance with the French Data Protection Act of 6 January 1978, personal data relating to purchasers may be processed automatically.
PHYTOCORSA A reserves the right to collect information on purchasers, including by using cookies, and, if it so wishes, to pass on the information collected to commercial partners.
Purchasers may object to the disclosure of their details by notifying PHYTOCORSA A. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of 6 January 1978.
Archiving - Proof:
PHYTOCORSA A will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code.
PHYTOCORSA A's computerised records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
